Delivery is not expressly defined in the stop notice statutes but is commonly defined as “the act of transferring something,” “the giving or yielding of . . . something to another,” or “the thing so transferred or conveyed.” Black’s Law Dictionary (7th ed. 1999). Thus, in its ordinary sense, to “deliver” means to actually transfer or convey. Such an interpretation of delivery is also consistent with Civil Code § 3162(a), which predicates the lender’s obligation to withhold on receipt of a bonded stop notice (“[…] upon receipt of a bonded stop notice the construction lender shall, …”).
The last sentence of Section 3103 also demonstrates that “deliver” and “give” cannot mean “personal service.” There, the Legislature defined “registered or certified mail” as having the same effect as “personal service.” Defining “deliver” or “give” to mean “personal service” would render the disjunctive “or” and the identified alternative of “serve” meaningless. For the words “deliver” and “give” to have any significance in the statutes they must mean something other than personal service and registered or certified mail-they must signify actual conveyance, transfer, or receipt.

It all happened so fast. I know the Toronto streets are busy, but I never thought I would have an accident like this.
